End User License Agreement

1. LICENSE GRANT

Tobias Hohendanner ("Licensor") grants you a personal, non-exclusive, non-transferable, and revocable license to use Eggspence ("Licensed Application") on devices that you own or control, in accordance with the applicable App Store Terms and Conditions and this EULA.

Important: The Licensed Application is licensed, not sold. All rights not expressly granted herein are reserved by the Licensor.

This license permits you to:

• Install and use the Licensed Application on your personal devices
• Create an account and store your expense data
• Share expenses with other users of the application
• Access all features included in your chosen subscription tier

2. RESTRICTIONS AND EXPORT COMPLIANCE

You may not and agree not to:

• Reverse Engineer: Copy, modify, reverse-engineer, decompile, disassemble, or create derivative works of the Licensed Application
• Redistribute: Distribute, sell, rent, lease, sublicense, or otherwise transfer the Licensed Application to any third party
• Circumvent: Remove, disable, or circumvent any security measures, access controls, or usage restrictions
• Violate Laws: Use the Licensed Application in violation of any applicable laws, regulations, or third-party rights
• Export Violations: Use or export the Licensed Application in violation of applicable export laws or regulations
• Misuse Service: Upload illegal, harmful, or inappropriate content, or use the app to harass other users
• Commercial Use: Use the Licensed Application for commercial purposes without explicit written permission

3. SUBSCRIPTION SERVICES

3.1 Ad-Free Subscription

If you purchase our "Ad-Free" subscription service:

• Billing: Billed monthly, auto-renewing unless cancelled at least 24 hours before the end of the billing period
• Payment: Charged to your Apple ID (iOS) or Google Play account (Android) upon confirmation
• Management: Manage, cancel, or modify your subscription in your respective app store account settings at any time
• Pricing: Prices may vary by country and currency. The exact price will be displayed before purchase
• Benefits: Ad-free experience and access to premium features as described in the app

3.2 Free Tier

• Core expense tracking and sharing functionality
• Limited group and expense features
• Advertisement-supported experience

4. PRIVACY, DATA PROTECTION AND TECHNICAL DATA

Your privacy is important to us. Our data practices are governed by our Privacy Policy:

4.1 Technical Data Collection

The Licensor may collect technical data including device performance metrics, app usage statistics, crash reports, and feature usage patterns. This data does not personally identify you.

5. INTELLECTUAL PROPERTY

The Licensed Application, including all content, features, functionality, and technology, is owned by the Licensor and protected by international copyright, trademark, and other intellectual property laws.

6. THIRD-PARTY SERVICES

The Licensed Application may integrate with:

• Google Services: Firebase, Analytics, AdMob advertising
• Payment Processing: RevenueCat for subscription management
• Platform Services: Apple App Store, Google Play Store
• Authentication: Google Sign-In, Apple Sign-In

Your use of these services is subject to their respective terms and privacy policies.

7. TERMINATION

7.1 Termination by You

• Uninstalling the Licensed Application from all your devices
• Deleting your user account through the app settings
• Discontinuing all use of the Licensed Application

7.2 Termination by Licensor

This EULA terminates automatically if you fail to comply with its terms, or if the Licensor suspends your access for violation of this EULA, misuse, non-payment, or at the Licensor's sole discretion.

7.3 Effect of Termination

Upon termination, you must immediately cease all use and delete the app from all your devices. Subscriptions will not be refunded upon termination for cause.

8. NO WARRANTY

The Licensed Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including merchantability, fitness for a particular purpose, or uninterrupted, error-free service.

9. LIMITATION OF LIABILITY

9.1 Excluded Damages

The Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, or unauthorized access to your data.

9.2 Maximum Liability

The Licensor's total liability shall not exceed the amount you paid in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Licensor from any claims arising from your use of the app, your violation of this EULA, or any content you submit.

11. GOVERNING LAW AND DISPUTE RESOLUTION

• For EU/EEA residents: Laws of Austria and applicable EU regulations
• For all other users: Laws of Austria, without regard to conflict of law principles
• For EU residents: You retain the right to bring disputes before the competent courts in your country of residence

12. UPDATES AND MODIFICATIONS

The Licensor may modify this EULA at any time via in-app notifications, email, or website updates. Continued use after modifications constitutes acceptance.

13. SEVERABILITY

If any provision is found to be unenforceable, it shall be limited to the minimum extent necessary so this EULA otherwise remains in full force.
